On Environmental Crime

The environmental problem has existed for a long time. It has not been solved in highly civilized society, but escalated. Every country began to pay attention to the environmental problems home and abroad after having been given a good lesson by nature' s revenge. People found that many environmental problems which were concerned with human being, resulted from environmental crime , so many countries punished environmental criminals by criminal law one after another. The paper proceeds as follows: introduction , text and conclusive words. As for the text it consists of three charts. Chart One explains the general introduction of the environmental crime. The first chart of the thesis gives a definition of environmental crime, analyzes the features of it and puts forward why and how it will happen in China after entering WTO. Chart Two talks about the shortcoming of the precaution and controlling system in current laws. The second chart of the thesis analyzes the reasons including shortcoming of the laws and the system of administrative, modern mankind making profit regardless of the balance of the eco system. Chart Three makes suggestion on how to precaution and control the environmental crime. The third chart of the thesis gives some advices on how to punish the criminals according to the features of environmental crime and its reasons after reviewing the history of law punishment on protecting the nature and absorbing the advantage of punishment on the criminals in other countries. And then it makes some measures to precaution and control the environmental crime. It tells us that we should punish the environmental criminals together all over the world because the environmental problems are globe . It also advises how to aim at it . Criminal law punishment is the severest method to punish the criminals and let the people who is about to commit think over and over .The criminals often give up crime because they are fear of the punishment. So perfect law punishment can effect on reducing the crimes at a unique way. Though the environmental crime is different from the other crimes, man can make strong punishment criminal laws and perfect administrative system , improve the system of responsibility, take economic measures to lead people to produce without endangering the environment, strengthen the education of environmental ethics and environmental protection idea. Our country can precaution and reduce environmental crime efficiently at last.
