| In view of marine resources compared with other resources is more international, marine environmental pollution control needs of all countries in the world,the pollution of the marine environment of a variety of criminal acts even greater need of curbing.In recent years,with the rapid development of the maritime industry,all kinds of pollution of the marine environment the high incidence of crime,a serious obstacle to international trade and the impact of the sea lanes.Punishment for the timely and contain various forms of criminal pollution of the marine environment, marine environment protection,the protection of human life at sea space,the international community have been a number of pollution of the marine environment punishing the crime of the International Convention on the availability of the major maritime countries to strengthen the domestic legislation in this regard,scholars of international law crimes legislation on marine pollution research also carried out. Research from the current perspective,the results of more limited legislative interpretation,for how to further pollution of the marine environment adapt to the characteristics of crime,how to punish such a serious and timely issues threatening human survival and quality of space and the perfect crime legislation,the States should how the provisions of the Convention in accordance with international development of domestic legislation and improve the issue of small,badly in need of thorough study.In view of this,I choose to write a dissertation on the subject,with a view to improving the pollution of the marine environment to punish crimes legislation to make some useful reference.This article is divided into four chapters,the first chapter is an overview of the marine environment crime,clear the environment,environmental crime,international crime,such as the marine environment based on the premise of the issue,focusing on the marine environment of international crime is a major international environmental crime,types of perspective;the second and three chapter of the international community of the marine environment,crime legislation,a general presentation of the main international convention on the criminal provisions of the marine environment, Japan,the United States,Britain and other major countries in the Criminal Code on the marine environment of the specific crime,and in accordance with their own understanding on the protection of the marine environment of the above-mentioned international and domestic legislation to be a brief assessment;Chapterâ…¢of the Marine Environment of China's criminal legislation on the status,problems and improve the proposal,in view of crime in China with pollution of the marine environment and other environmental crimes brought about by many of the drawbacks, I propose the establishment of a separate criminal pollution of the marine environment of the legislative proposals,and the object of their crime,criminal objective,the main crime,crime subjective some of the problems of his own thinking and recommendations of immature. |
