Study On The Legislative Measure Of Coastal Zone Management Law

The coastal zone is populous and prosperous, however, the increasing exploration and development seriously affect its balance, and induce environment polluted and resource destroyed, which is disadvantage for its continual development. So the exploration of resource, the protection of environment and the scientific management in coastal zone are what people pay attention to. Many coastal countries enforce the program of integrated coastal zone management through legislation with the appeal of the international organizations. In the recent years, our country pays more attention to the management of coastal zone than ever, but the legal system of sea is required to be reformed. In order to secure the continual development, our country should enact the Coastal Zone Management Law. Through carefully studying on the primary theories, the author wishes to make some useful suggestions on the legislation of the coastal zone management.At first, the dissertation discusses the basic conceptions of the coastal zone management law, including coast, coastal line, coastal zone, coastal zone continual development, integrated coastal zone management and coastal zone management law. And it introduces the legislative experiences of some countries, inc., America, France, Japanese, Korea, which are useful for us. After the dissertation discusses the conditions and weak points of our national legal system on the management of coastal zone, it draws a conclusion that, based on the theory of continual development the Coastal Zone Management Law should be enacted quickly. Finally, on the ground of the domestic conditions the dissertation narrates the legislative measures on the coastal zone management law including legislative mode, legislative principle, legislative purpose, the definition and scope of coastal zone, the construction of harmonious management system, the unification of the executants and several legal systems of integrated coastal zone management.
