The Study Of News Work's Copyright Limit System

The news work is different with the current event news, it owns the copyright. Therefore it can get the copyright law protection, but correspondingly, it will be restricted by this law. The protection and limit or works which have copyright depend on each other. In a sense, the protection of one side means the limit of the other side. The reinforcement of the work protection can drive author's creation enthusiasm, but if protects creator's benefit excessively, the social public approaches the copyright work to be able to receive the hindrance, like this instead does not favor the work the dissemination, does not favor the entire cultural establishment the development. Therefore, how to get the balance of different sides to a certain degree will be the intention of legislating copyright. The system of copyright' s limit appears as the corresponding object to the system of copyright' s protection. Judging from different angles, such as Jurisprudence, Constitution study, Economics, Communications, the system of copyright limit' s appearance has its profound basis theory and practical significance. As the system of copyright' s limit, it will realize the benefit' s harmony in copyright' s field. This article adopts text analytic method and comparison method to do some research on the law about the system of the news work' s copyright limit in our country. And we find that it is in low proportion in the whole copyright law. The legislators seems that they don't take the limit ofcopyright into consideration. After comparing two different famous copyright laws, we find a trend. In such a circumstance that traditional medium use news work, the system of copyright limit' s space is decreasing. There is no relevant rules about situation that the news media adopts news work in copyright laws in our country. This "vacancy" in law leads to the situation that no judging means to net' s copyright. In real life, so people will feel confusing. Finally, there are tow suggestions: the first one—on the basis of the copyright protection system' s construction, it will strengthen the perfection of it and form the balanced mechanism of it in our country. The second one—we should speed up the construction of the system of net' copyright limit thus the spread of new works in net will be easy to operate and will be standardized.
