In this dissertation, the author tried to explore the internet and newtechnology to bring to the impact of the traditional law system and the approachto resolution. This paper is composed of two parts.In part I, the author researched the combination of digital technology and theinternet challenges the present copyright institution. Technical measures indigital copyright management afford the holders a private protectionmode .However, in the process of digital copyright management, there may besome impediment to public interests. In digital circumstance , how to look forthe protection from the tradition law? I tried to analyze this institution by thevision of the economics, and to expand the institution of fair use constructively.In part 2, the author reflected and tried to investigate legal research how toface and answer to these complicated questions in the process of the updatingtechnologies and the transforming society. I proposed the young legal researchersshould have confidences and abilities to purse the scientific approaches of thelegal researches with the help of the other social sciences and humanities.
