Introspection And Prospect Of Construction The Law-ruled Government In Transformation Period

Ruled by law pours rationality into China's system, and the core and key to build up law-ruled country is to establish a government by law. The government by law is a question of which theory and practice pay equal attention to coexist, no matter from the broad sense by some scholars' (equates in a country under the rule of law), or the narrow sense angle which analyzes emphatically in this paper (administrative organizations governed by law). Transformation period of the society has an important realistic value to the research of law-ruled government. The article proceeds with natural law, combs the western law-ruled and the theory resources of law-ruled government, further analyses the defect and obstacle of establishing a law-ruled government from culture angle, system angle, and government itself, etc, and puts forward the corresponding completion measures in terms of theory and practice. Finally, from the character and reality of the law-ruled, it proposes that China's law-ruled system shall be on different ways from the westerns combined with Chinese current situation; explores to give first place to law-ruled, then use moral to be assistances in ethics society; criticizes the utopianism of the law-ruled government, to believe that the government by law will be an evolutional and rational-constructed process.
