On The Real Estate Management Legal System

With a history longer than a hundred years overseas, real estate management has merely existed for two decades in China. Due to imperfect legal system, the immature development of China's real estate management has resulted in the continuous occurrence of conflicts and confrontations between owners and real estate management companies. Furthermore, the owners' rights have been seriously infringed on and the vertical development of real estate market has been restricted. Based on civil and commercial law theory, this paper tries to explore the following topics: real estate management legal relations, common disputes concerning real estate management, the reason of disputes and advice the legal countermeasures.This paper includes three parts: introduction, main body and conclusion.The introduction part gives a picture of the status quo of present real estate management in China and the significance of this research.The main body includes four sections as follows:The first section is the development of real estate management and its legal adjustment. The birth and overseas development of real estate management are introduced. In spite of different names this particular law is given in different countries to distinguish real estate, the content is basically same, i.e. to adjust and distinguish the rights and obligations of the real estate owner and further regulate the management of building and safeguard the security in the communities. Main problems and situation of China's present real estate management are discussed with the aim to locate the factors behind.
