The Research On Some Issues About Chinese Travel Contract

As a result of the inefficiency of our current laws and regulations in the travelling industry which far lag behind the industry's growth, many legal disputes between the travel agents and their clients can be handled neither fairly nor efficiently. Legislating and completing the laws in the travelling industry are an urgent issue. At present, however, the legal scholars have not agreed on some basic concepts and mechanisms of travelling contracts. To inspire more thoughts along with the debate, the author discusses the three basic but essential systems of the travelling contracts in the paper.There are three major parts composing this paper:In the first part, the author discusses the defects associated with the content of the standard contracts between travel agents and tourists as well as the corresponding regulations. The discussion is based on an analysis on a sample contract provided by a travel agent to exemplify the unfair and even illegal terms in many currently valid contracts. Deliberately and abusively using these defected contracts which are hallmarked by ambiguous and vague terms, agents either excuse themselves from undertaking their responsibilities or lay more responsibilities on their clients. Naturally, the corresponding regulations or policies aimed at correcting these defected contracts are essential and important to protect the clients'very rights and ensure the order of the industry.
