Study On The Legal System Of Strategic Environmental Assessment

Strategic Environmental Assessment (SEA) is an application of Construction Project Environmental Impact Assessment (PEIA) in a strategic level. It can prevent the bad influence to the environment on account of enact a strategy. Besides, there is also a great significance in promoting the comprehensive strategy between environment and development, along with the realization of a harmonious development between economy, society and environment. On Oct. 28th, 2002,"Environmental Impact Assessment Law"was passed in our country. The current environmental impact assessment only on construction projects has been expanded to the environmental impact assessment on development program, which is in order to prevent environmental pollution and ecological damage from the strategic source. This marked a new ear which environmental and natural resources legislation in our country has stepped into and is also a historic jump. This dissertation intends to give a systematic study on the legal system of SEA.This dissertation firstly provides a systematic introduction to the definition, characteristic, background and covers our analysis one the theoretical basis of the emergence of SEA from the perspective of economics and the theory of sustainable development. In the second part of the dissertation, we introduce the correlative regulation and practice of SEA in some foreign countries, such as the U.S., Britain and Canada etc. as well as some international organizations, such as EU, UN etc. The third part elaborate the necessity and theoretical and practical status quo on the construction of SEA in our country and point out the problem we faced currently. In the last part, according to the status quo of SEA in our country, along with benefiting the correlative advanced experience of foreign countries, we present our suggestion on improving the regulation of SEA in our country, respectively on legislation principle, evaluation body, apply extension, examining and proving body, public participation, legal responsibility and etc.
