Informed consent is the most basic and key right of patients. Many nations have paid attention to strength the protection on this right. This thesis gives an illustration on such basic problems as origin and development, concept, execution and civil-law protection of the informed consent. On this basis, the author probes into the problems of legislation on the informed consent in china and bring forward feasible solutions for perfecting this right.Informed consent came in to being and developed with the human-rights movement, the change of the relation between practitioners and patients, and the transition of medicine mode.The basic meaning of the informed consent is that the patient is entitled to know his diseases, medical measures and risk involved and etc, and to freely make decision on whether accept or refuse these medical measures. The informed consent is a personality right, a basic human right and an assistant right which can protect the rights of life and health.The subjects of execution of the informed consent include the patients, their statutory agents and mandatory agents. Possessing capability for consents is the basic qualification of executing the informed consent. The content of the informed consent includes the right to know and the right to consent. The right to know of patients rely practitioners'disclosure. Generally, there are four standards of practitioners'disclosure.
