Study On The Dilemma Of Chinese Environmental Law Enforcement And Its Perfection Mechanism

Relying on the technology, the human being created unprecedented material civilization, meanwhile, the material civilization also has destroyed the natural environment on which people rely for existing. With the development of the whole world industrialization, the environmental pollution and environmental disruption have already becoming the world problem that is bullying the human being to exist and developing. As a developing country, Chinese environment problem is also accompanying Chinese socialist modernization and have already brought about a series of significant negative effect on Chinese economy, society's all-round, coordination and sustainable development.As the forceful legal institutions means, the environmental law enforcement has important positive effect on resolving the environment problem, cracking down the environment law-breaking activity and especially promoting environment management. Currently, the Chinese environment situation is confronted with austere circumstances. In the process of transferring planned economy to market economy, drive by economy benefit, some enterprise defies environmental protection law and regulation to discharge pollution wantonly. Especially, some grass-roots unit of environmental protection is organizationally imperfect, so the environment surveillance is still in the comparatively weak state. In addition, affected by the regional protectionism, the environmental law enforcement is short of authority and independence gravely. In new economic growth, how to strengthen the environmental law enforcement, improve the environmental law enforcement efficiency and control environmental pollution and ecocide has become an All-important problem.This article is based on previous study and writer's practical experience of environmental law enforcement to analyze the dilemma of Chinese environmental law enforcement and its perfection mechanism. The article is divided into the following six parts: part one put forward the environmental law enforcement, part two is about the concept, the basic principle and the essential features of the environmental law enforcement, part three summarized the current situation of Chinese environmentallaw enforcement, part four analyzed the dilemma that has been confronted with by Chinese environmental law enforcement thoroughly, part five introduced USA environmental law enforcement systematically and analyzed the gap and deficiency between USA environmental law enforcement and Chinese, part six summed up the relevant measure and mechanism to remove difficult position of Chinese environmental law enforcement, and especially probed the contract of protection environment, the reward system of environment administration, the environmental law enforcement's system of illicit job responsibility, and the superintend mechanism of the environmental law enforcement.
