Conflict Between Administrative Law Enforcement And The Dilemma Of Law Enforcement Of Public Security Department And Its Countermeasures

Since the Reform and Opening Up, the great achievement has been made in China through the legal construction for decades, meanwhile the complete system of administrative laws was set up. In the process of social development, various forms of conflicts of administrative enforcement were arising. To avoid the matter of disputes in regimentation or application of articles, and improve the system of administrative laws, the principle for law application was established. Furthermore, the Legislation Law issued in2000, formulates in detail the rating of effectiveness for all legal documents in administration.Starting with the conflicts of administrative enforcement and basing on empirical study, this article analyses the cause of formation from perspective of law enforcement personnel as well as the negative effects on the criminal investigation from the conflicts of administrative enforcement, and highlights the far-reaching impact from rule of man of chief executive. The article consists of five parts. The first part is introduction, which leads to writing purpose, and the analysis of conflicts of administrative enforcement and its contributing factors by other researchers. The second part expounds the conception and classification of conflicts of administrative enforcement, as well as the principle of administrative enforcement. The third part analyses the contributing factors of conflicts of administrative enforcement and law-enforcement dilemma. The fourth part states the influence upon the domestic and external surroundings from conflicts of administrative enforcement. The fifth part introduces the existing methods for solving conflicts, and brings forward policy suggestions.
