In recent years, along with international trade and international technique exchanges of development, the problems such the forge trademark, counterfeit infringement etc. that also becomes the outstanding problems within international trade gradually. The Customs of the People's Republic of China is a state organ responsible for the supervision and control over all arrivals in and departures from the Customs territory. The customs function that prevents infringement goods from importing or exporting becomes more and more important.But, long term, there are three greatest problems perplex the skeleton crews who work in the intelligent property protecting. Settling the card process to affirm the infringement? Whether the parallelism import should be prohibited? Does the customs should protect the patent right? These problems still do not find out the definite way .Along with our country intelligent property right protection law system becoming more and more perfect, all the above problem passes the lawmaking to protect the procedure to design afresh, which that can open a convenient way to reduce the risk of customs inspection, alleviating the responsibility .But to the right persons and the consumers, it is unfair .Even that can disfigure the customs social services.In this dissertation, we discusses intelligent property right customs protection administration how to break through siege the predicament by focusing on the current law system frame , using for the aboard customs usefulness reference ,how to transform the way in order to reduce the risk of customs inspection ,alleviating the responsibility. By the reasonable way we can benefit from the intelligent property right of customs.
