The inclusiveness and openness of the national culture in Tang Dynasty made it the most prosperous age in the feudal period.As the earliest and most complete extant feudal code in China,Tang Lv Shu Yi is extremely representative and an important milestone in the history of ancient Chinese legal system.Among them,the "law of marriage" stipulates in detail the legal norms related to marriage and family,supplemented by Tang decrees and rites,and combined with the thoughts of "combining rites and laws",men being superior to women,the power of the husband and the power of the father as the principle,formed a perfect marriage system,and had a profound impact on later generations and surrounding countries and regions.The article is divided into four parts to explain the dissolution of marriage system in the Tang Dynasty.The first part mainly introduces the legal origin of the dissolution of marriage system in the Tang Dynasty,which takes the Qin and Han Dynasties as the main object of exploration,and mainly explains the ideological origin and legal basis of the "Qi Chu" and "Yi Ju" in the book of rites.The second part mainly introduces the content of the dissolution of marriage system in Tang Lv Shu Yi,combining theory with practice.It not only expounds the relevant provisions of the dissolution of marriage system in Tang Lv Shu Yi,Tang decree and Li,but also resolves the contemporary dissolution of marriage system with judicial cases.The third part introduces the procedure and effectiveness of the system of dissolution of marriage in the Tang Dynasty,aiming to understand the procedural law of the system of dissolution of marriage in the Tang Dynasty,and truly reflect the characteristics of the combination of procedural law and substantive law of the system of dissolution of marriage in the Tang Dynasty.The fourth part mainly introduces the evaluation of the dissolution of marriage system in Tang Dynasty,which not only provides reference for the later generations of the dissolution of marriage system,but also has a profound impact on the dissolution of marriage system in surrounding countries and regions.The legislative aim of the marriage system in Tang Dynasty was to pay attention to the interests of patriarchal clan,maintain the family harmony,consolidate the social order and strengthen the rule.
