The liberation of women starts with the fact that they step into society and get involved into the social work. Recently, the number of women who take part in the labor work is increasing with a high speed. Nevertheless, women are faced with sex discrimination in the process of employment which has been a common phenomenon in the world because of the impact of traditional conception and subjective and objective conditions as well. As for the contemporary legislation, no appropriate or universal remedies are afforded. In order to re-evaluate women's labor right and its realization and find out resolutions to overcome the discrimination in employment, this article discusses the essential attribute of labor right, assesses the current situation of sex discrimination and analysis its basic reasons by means of induction, comparison, examples and diagram and the like.Started from the fundamental theory of labor right, the article demonstrates that labor right bears the essential attribute of freedom right by tracing its derivation and general laws. It, based on this premise, also focuses on the realization of women's labor right, especially deals with the background that sex discrimination arose from in China. The author holds the viewpoint that we should never neglect the objective reality that the supply of labor force exceeds the demand as a whole in Chinese labor market. Finally, the article puts forward several suggestions for the modern society to fight against sex discrimination in employment: defining the connotation of sex discrimination and women's labor right; setting up the relevance principal as the criteria; bringing in the responsibility of contrahendo; establishing the labor public welfare litigation system; promoting the socialization of housework; improving the methods to settle disputes; accepting cases that labor right is violated; and the last one, establishing specialized agencies to supervise and insure the equal rights to employment.
