Peasant-worker is an especial group in process of industrialization and urbanization during in the period of china society transition. They have made great contribution to our country's social and economic development. But they don't get what they should be given in the labor market. Serious employment discriminations impaired greatly the equal employment right of peasant workers. So this paper is intended to explore what is the equal employment right of peasant workers and how to protect it. There are four parts in this article.The first part is the analysis on the connotation of the equal employment right of peasant workers. The equal employment right is a set of rights that contains equal employment opportunities and other employment rights, such as the right to get salary, the right to social security and the right to vocational training. And the equal employment right of peasant workers reveals its own particularity because of the special subject. The compound peasant-worker signifies the combination of their social identity and the working post,"peasant"and"worker"embodies their social identity and working post respectively. Thus they are called the third element in social structure. They are different from city residents and also different from village residents. So their equal employment right needs special protection.The second part introduces the present situation of the equal employment right of peasant workers. According to the connotation of this right, this part discusses some serious employment discriminations that infract equal employment opportunities, the right to get salary, the right to social security and the right to vocational training.The third part analyses the reasons resulting in such phenomena. One reason is peasant-worker'poorer quality. And they don't have clear consciousness and enough strength to protect themselves. The other reason is that our legal rules are insufficient for protection of the equal employment right of peasant workers. Our constitution does not define the freedom of migration, but set up the different systems of the household register in urban and rural areas. This is the root of the damage which occurs on the equal employment right of peasant workers. At the same time our labor law does not give peasant workers enough protection, even that we can find out some rules about employment discriminations in other laws and regulations. These factors make it more difficult for peasant workers to obtain employment.The fourth part is about how to protect equal employment right of peasant workers. It is the most important part. The writer discusses some ideas about legal systems.Firstly, we must establish the system of combating labor market discrimination. Our constitution should define the freedom of migration again. On the basis of the freedom of migration we can accelerate the reform of the household register system. Bestow urbanites and peasants equal identity of resident to create equal chances for them. And as the important part of this system, effective and practical legal rules just as the employment promotion law and the corporate regulation of the wage should be put forward as soon as possible.Secondly, we should reform the social security system whose focuses should be injury and medical insurance and endowment insurance. This system could use the low-rate and convenient method to make it accord with the especial need of peasant workers. It will help peasant workers to realize their right to social security.Thirdly, we should perfect the service system of peasant workers employment. The government and employers should provide enough employment information and professional training to enhance the employment competition ability of peasant workers.Fourthly, we should enhance the establishment of peasant-worker's organization system. Bring our party, communist youth league and trade union into full pay to enhance peasant workers'power. Make peasant workers believe that depending on our party, communist youth league and trade union is the best way to protect their equal employment right.
