A Research On Law System Of International Non-Proliferation Nuclear Weapon

The nuclear weapon is the biggest threat to the existence and the safety of human beings. To prevent the proliferation of nuclear weapons is a very important problem concerning the safety of mankind. Nowadays the international society established a law system about this by making the Treaty on Non-Proliferation of Nuclear Weapons as a center while making the bilateral and multilateral agreement between the countries.Although there has been a long time since the law system of the prevention of nuclear proliferation established, the author still found many problems in some respects about the system through my research. That's why the conflicts in this field are always dominated by politics instead of the law. Because the law system of nuclear weapons non-proliferation focuses on providing a guarantee to the interests of the nations having nuclear weapons, maintaining the current international nuclear situation, forming the different treat, which must lead to some dissatisfaction and attacks of countries without nuclear weapons. In fact, the nuclear explosion in India and Pakistan has already broken the rule and North Korea and Iran are going to break this rule too. The law system of the international nuclear weapons non-proliferation is facing a crisis and challenge that never met before.This essay is to find the crucial reasons through the research and the analysis of the historical forming, characteristics and content system of the law system of the international nuclear weapons non-proliferation. Moreover, I try to seek the interest balance point between the countries having and not having nuclear weapons in order to make the solution of the international nuclear weapons crisis to the law system.The essay contains four parts, which has about thirty thousand words. Its main content is as follows:The first part summarized that the nuclear weapon is a threat to the human beings. It expounded the essentiality and the importance of the law system of international nuclear weapons non-proliferation ranging from the historical forming of the system to the complicated international nuclear crisis. It also showed the principal problems that the law system has to work out.The second part studied the main content about the international nuclear weapons non-proliferation. In this part, I analyzed the international treaties to get the basic principles and essential worth that the system shows and studied the three important systems in the law system which are safety guarantee system, non-nuclear region system and the system of the supervision and management about nuclear materials.The third part used demonstrations and examples to conclude that the defects and the leaks reflecting in the practice of the nuclear weapons non-proliferation system and analyze the shortcomings of the system. After that I provided some opinions to improve and perfect the law system aiming at these defects and leaks.The last part analyzed the relation between China and the international nuclear weapons non-proliferation system. Through the study of the functions and the contributions that China provided in this law system, I searched for the more significant role for China to drive the nuclear weapons non-proliferation system in the future.
