Takes this as a chance, the article involves how to establish and perfect our country's legal system on food safety. As the basis of the whole task, the article first defines the interrelated concepts, makes brief analysis on how to define food and food safety in law field, and also on what kind of content and characteristic food safety should be. Then the author lists the realistic situation of food safety and the main factors that influence the situation in our country. There is a long history of legal protection on food safety in the EU and US, and there is a comparatively perfect system, which is worthy of being learned. Another's good quality or suggestion whereby one can remedy own defects, so the article introduces the food safety law system, the supervision system and other legal system of EU and US, such as traceability system, food return system, emergency response mechanism, risk management system and so on. Through several years accumulation, we obtain certain results on food safety system, but compare to the EU and US, there is still a lot of defect and drawbacks, there is a lot of problems need to be resolved, which the article shows. After analyzing our food safety legal system, the article puts forward suggestions on perfecting our food safety legal system, coordinating the existing law system, and on harmonizing the existing supervision system, the article advises establishing a basis food safety law, which run through the eidos of food safety, and set up food safety commission to coordinate the existing departments, and learning from the advanced experiments, the article proposes a series of relevant protect system, such as risk management system, traceability system, unified information system, defect food return system, and reputation system.
