A Study On The Farmland Circulation System

The farmland is the most basic material for agricultural production, and also constitutes the fundamental living condition of all farmers. The establishment of an efficient system for right of farmland use is closely related to not only the proper allocation of agricultural resources , but also to the healthy development of rural market. The development of market for farmland obviously lags behind the whole market economy. It has been a most pressing and important subject for us to push up the circulation of farmland use and realize the integrated management lawfully and rationally in order to meet the demand of modernization and industrialization of this country's agriculture. The social and economic development makes it certain that the farmland use right will be put into circulation. Since the farmland is the basic factor to safeguard the living of farmers, the circulation of which must be a gradual process and needs proper regulations.Based on the reality of rural area of nowadays China, this thesis analyses the ongoing farmland circulation and puts forward some advices on the perfection of farmland circulation system. This thesis is divided into four parts.First part General theory on the farmland circulationThe author firstly gives clear definition about these conceptions: farmland, farmland use right and circulation. The author points out the difference between the farmland and the rural land, at the same time analyses the necessity of farmland circulation. Second part Legal system of farmland use rightThe first portion of this part is on the means of obtaining farmland use right: usual ways and exceptions. The second portion involves the nature of farmland use right. The author reaches the conclusion that the farmland use right is a kind of usufruct. The third portion discusses the contents of farmland use right, besides the right to use ,possession and enjoying the profits, it also includes the right of disposal and claim.Third part On the circulation system of farmland use rightIn this part, the author firstly gives a general description of its history, secondly briefly introduces the policy on the farmland circulation, and thirdly points out the problems existed, e.g.. small quantity and narrow scope. Finally the author describes the different circulation forms in more developed area and less developed areas.Fourth part Suggestions on the perfection of circulation system of farmland use rightBased on the analysis made in the above four parts, the author puts forward suggestions of five aspects including advices on relevant legislation, principles that should be stuck to and measures of promotion etc.
