In case of sudden public events in the present world, management on public crisis is vital to every country's government, and an important symbol to judge whether the government could act in accordance with law in modern legalized country.China SARS event in 2003 took a tool on us, exposing various shortcomings and detriments. Thus it is important for our government to improve the party's governing capacity, in order to cope with sudden public events effectively.So far many countries'governments and various organizations pay high attention to management on public crisis on the basis of law , while we are still on the process of exploration.This paper collecting a great deal of valuable materials, takes a serious attitude to carry out an initial study on public crisis management and legal emergency mechanism both in theory and in practice, bring forward the importance and urgency of legal construction in governmental crisis management, combing with the case research method.Firstly, the author analyzes the definition of public crisis and characterization there of on terms of macro aspect, summarizes the implication of governmental crisis management.Secondly, this paper states governmental emergent power in crisis management in detail;At last, paper analyzes the present situation of litigation on crisis management, incorporating the successful experience of foreign legalization in the area of crisis management; then presents the concrete litigation advices in accordance with our fundamental realities of the country.In modern legalization society, governmental power stems from the publics authorization. In the period of public crisis, government shall act conforming with the content of constitution and laws; although government has taken various effective emergency actions in form of policies.
