Administrative Agreement System Under The Regional Governmental Cooperation

As the rapid economic development in China, regional economy has developed to different degree, which lead to unbalanced economic development in different areas.Due to the similarities in geography, economy, culture, etc., economic development in some areas reflects obvious regional characteristics, such as Yangtze River Delta Region, Pan-Pear River Delta Region, etc. All the regions are pursuing the biggest common benefit under the influence of market, the'invisible hand'. However, the existing administrative division restricts the further development of regional Economic Integration. In order to solve this problem, regional governments have found out a creative system in practice to push and promote regional economy by regional governmental cooperation, of which Administrative Agreement System is right one important part.This Thesis is mainly focused on the administrative agreement system of environmental cooperation in Pan-Pear River Delta Region, discussing both the theory and practice of this creative system in various dimensions. Besides the Introduction part, this thesis consists of four chapters, and each chapter's brief introduction is as follows:The first chapter introduces the research background of administrative agreement system problem under the regional governmental cooperation, which is the practice of regional governmental cooperation and regional economic integration. Then this chapter gives a brief introduction of current domestic scholars'research progress. Basing on the previous content, this chapter gives a definition of administrative agreement and discrimination of relevant concepts.The second chapter raises the main difficulties of regional governmental cooperation, which are regional economic integration and the established division of administrative regions, and also provides theory analysis on choosing administrative agreement method to solve this problem. Then this chapter explains specifically on the administrative agreement under the regional governmental cooperation by taking the environmental cooperation of Pan-Pear River Delta Region as an example, reviewing and analyzing its development process and the agreement content, which paves the road for the following description on the problems of theory and practice.The third chapter is mainly about the theory issues of administrative agreement under regional governmental cooperation, which consist of the legal basis and legal effect of administrative agreement. Basing on the experience of relevant countries and starting from the administrative and contractual characteristics, this chapter researches on the effect of then environmental cooperation in Pan-Pearl River Delta Region by comparing of the current situation.The fourth chapter studies on the relevant problems in practice of the administrative agreement under regional governmental cooperation by example of the environmental cooperation agreement in Pan-Pearl River Delta Region. Due to the restriction of study skills and materials, this chapter mainly researches on the contracting parties, contracting procedure, and the entry into force of administrative agreement. This chapter expresses opinions and suggestions basing on analyzing the current practical problem and experience of relevant countries, and also tries to standardize and improve administrative agreement under regional governmental cooperation by designing systems.As the new thing caused by administrative practice, the administrative agreement system under regional governmental cooperation involves and contains wide and complicated contents. There is neither clear definition in law nor enough attention in administrative law scope on this creation in administrative practice. The practice of regional economic integration development needs discussion and study on this creative governmental cooperation system, in order to build up the long-term effective and steady law system of regional governmental cooperation and avoid this creative system becoming'flash in the pan'due to the uncertainty of law and theory.
