Labor creates human being. Working is the most important social activity and also the source of wealth. Labor rights are related with every citizen's survival and development. Due to this, they are written into constitutions of many countries. To safeguard the labor rights is not only concerned with every citizen but also concerned with the order of the whole society. The development of the right and the improvement of its law mark the development of human right and the improvement of the society.Labor rights were created by the strength of the working class and the development of liberalism in the 19th century. It shows workers struggles for their free rights and personal dignity. Since the rights were written into law in France in 1848, many countries followed and gradually they were written into constitutions. Also, the international laws began to stipulate these human rights. Law makes these rights have the support of the nation which pushes its development. Labor rights are not a single right. It is a bunch of rights including the right to work, the right to get salaries, the right to rest, the right of vocational training, the right of job safety, the right of union, the right to negotiate and the right to strike.Under the circumstance of planned economy, the labor relation was simple and the number of conflicts concerned with work was small. However, with the development of market economy, the relation between labor and capital has changed. The awareness of right also increases the number of labor conflict. How to realize and safeguard the labor right becomes a focus to which we should pay more attention. This paper introduces the historical background of labor rights, compares different opinions of scholars on this conception and contrasts the current feature of labor relation and realization of labor rights with the past ones of that. The study of labor rights will contribute to our understanding of its conception and content and the comparison between current characteristics of labor relation and past ones of that will help us be aware of the present problems and try to find proper solutions to them.
