An Empirical Study On Community Correction Of Elderly Delinquents

Community correction is an execution system,which is developed based on the punishment concept of socialization of execution,leniency of punishment and humanitarianism.As a non-custodial punishment method,community correction has its unapproachable advantages in terms of reducing execution cost and socialization due to its open prison place.At the beginning of the pilot program of community correction,China has already noticed the group of elderly criminals,and subsequently issued some regulations for the implementation of community correction for elderly prisoners,but the level is relatively low.The newly issued Community Correction Law of the People’s Republic of China does not specifically mention the community correction of elderly criminals,which leads to the neglect of the particularity of elderly criminals by community correction institutions.The elderly criminals who have relate to community correction have their particularities in physical,psychological,social relations and crime types.Therefore,individualized corrective measures can better improve the effect of community correction on the elderly criminals.The implementation of community correction for the elderly criminalsis also the basic requirements of the leniency of punishment and the humanity of execution.I select the elderly criminals who have relate to community correction in the recent three years as the research sample.Using my work in C city bureau of community correction internal system achieve real and effective data of elderly people.To make correction,summarized the data statistical analysis,found the old crime exists in the process of community correction to the old crime community correction execute others,not lack of individualized humanization and corrective measures.Through the analysis of the above problems in the execution,humanization and individualization of community correction of the elderly offenders,it is found that the causes of the problems are diverse,and relevant suggestions for improvement are put forward.For the community correction of the elderly offenders,the characteristics of the correction objects should be considered.The measures such as individualized correction scheme and differential correction scheme should be adopted,as well as measures such as intelligent correction and close relatives supervision guarantee,and the effectiveness and humanization of community correction of the elderly offenders should be taken into account.
