Educational service falls into the category of service trade, which is a very important aspect of the Service Trade General Protocol of WTO. The entering the WTO of China has made the education in China has been geared into the World Education. Under the framework of WTO, our educational service trade has made great progress and in the meantime WTO is producing a profound and comprehensive effect on our educational service trade. Therefore, it is very necessary to make a study of international educational service trade under the basic framework of WTO.This thesis deals with the market opening and the law supervision of the educational service trade under the framework of WTO in China combining with the relative international rules and regulations of educational service trade and it consists of four parts:Part I It deals with the basic situation of the educational service trade based on the rules and regulations stipulated by WTO. This thesis defines the educational service trade as "Except the teaching activities completely sponsored by the government, all teaching activities charging tuition and bearing commercial nature and the import and export trade of the educational products and materials concerned"; it also introduces the division of the educational service trade, the subject and the object of the educational service trade, the four kinds of providing the educational service trade and the definition and the scope of the educational service trade barrier.Part II It discusses the basic principle of the educational service trade under the framework of WTO and our promise entering WTO. By interpreting the fundamental principles of the educational trade, it enables the readers to come to the conclusion that only by understanding the " double-faced" properties of the trade barriers profoundly and make reasonable uses of the basic principles of WTO can we develop our international educational service trade healthily by maximizing the advantages and avoiding the disadvantages. Part III It deals with the market opening and the law supervision of the four kinds of providing the educational service trade, that is, cross-boundary payment, consumption in foreign countries, natural flow of human beings and the existence of commerce and emphasizes the relevant problems arising from the joint China cooperative school running.Part IV It introduces the current legislation system of the educational service trade and points out the current situation of the educational service trade and the difference from the promise we made when entering WTO. At the same time, it puts forward the suggestions for improving the market opening and the law supervision of the educational service trade from the aspects of sticking to the relevant rules and regulations of opening moderately and improving the educational service trade as well as reinforcing the supervision and management of the educational service trade in order to facilitate the healthy and good development of the educational service trade in China.Conclusion It draws the conclusion and emphasizes the necessity of analyzing the market opening and the law supervision of the educational service trade under the framework of WTO and points out that it still has to be further reinforced.
