Study On Coastal Ecosystem Management Law

Ecosystem management is regarded as the direction of international environmental law. This paper keeps up with this trend, coupling the idea of ecosystem management to legislation. Environmental degradation of coastal ecological system is known as one of the most serious problems, but the legislation of coast management cannot satisfy the actual need. A new scientific approach ----ecosystem management is introduced into the coastal protection legislation. This paper follows the "reality - theory - practice" train of thought. Firstly, according to the coastal ecological system in China, this paper analyzes the reasons of the degradation of coastal ecological system and then analyzes the current policy and legislation. Secondly, ecosystem management theory is expounded. The necessity and characteristic of coastal ecosystem management is analyzed .Thirdly, through the comparison of domestic and international ecological system management, this paper puts forward a comparative analysis of the connotation of the coastal management legislation. Finally, some important system will be introduced.The paper includes three parts: actuality evaluation, theoretic analysis and application framework.The first part is the condition of coastal ecosystem protection of China, including the first chapter and the second chapter. The first chapter introduces the concept and characteristic of the coastal .With the rapid population and economic development, the environmental problems of the coastal ecosystem have become increasingly prominent, such as the decreased quality of the ocean environment, the deterioration of ecological environment, pollution, overfishing and coastal engineering. So many man-made factors on the coastal ecosystem make increasing damage. The reasons are "population excessive growth, the population is enormous pressure; lack of macro plan; administrative system is in chaos; basic research is so weak, the monitoring system cannot meet the need" and so on. The second chapter introduces the process of the coastal management, we went through "inoculation produce period", "development period" and "sustainable development period". And then the period of "emphasis on system" ecosystem management buds. There are so many problems of the coastal management in China, such as "the lack of comprehensive management law; ignorance of resources protection law; blank of marine management laws and regulations; the current existence defects of the coastal ecosystem law. The essence of reason is the legislation does not stand in society - economy - natural compound ecosystem standpoint, failing to treat the problems comprehensively.The second part is the analysis of ecosystem management methods, including the third chapter and the fourth chapter. The third chapter introduces ecosystem management principles, the ecological system management concept and the development of the ecological system management. The necessity,characteristic and feasibility of coastal ecosystem management is analyzed . The fourth chapter selects the United States, the Netherlands, Canada and Japan to analyze. These several countries coastal management law has the significant characteristic and puts an important influence on other countries. Through the analysis of overseas, we get a lot from the object,policy,ocean plan,public participation and management agencies.The third part includes the fifth chapter and the sixth chapter. Chapter 5 first analyses ecosystem management law from the significance of fundamental values, legislation, standard and the purpose of legislation, the management of institutional construction, basic principles. The sixth chapter combines with ecosystem management advanced concept. The sixth chapter puts forward some important system, such as monitoring system, functional zoning system, the system of Marine nature reserve, standard system, environment protection regional cooperation system.
