Research On The Legislation Of China’s Wetland Protection

In recent years, the legislation of wetland protection develops fastly,the regulations on wetlands protection and management,appears as special legislation of wetland,and a lot of legislation in local area,this regulation defines the wetland,to solve the confusion of the unknown wetland’ definition. This paper introduce the implication of wetland. We analyze the significance of legislation of wetland protection deeply.The analysis to the present situation of china’s wetlands shows that the destruction of wetlands is serious and cutting,although in recent years,some measures of restoration and protection to wetlands,and achieved some achievements,but overall the situation is worrying.After the analysis of the quo situation of china’s national law,the legislation of wetland protection made achievements,at the same time,the legislation of wetland protection has defects,including three aspects:firstly,the wetland protection legal system is not perfect,the national special legislation is not perfect,legal provisions of related wetland lack coordination,local laws of protection wetland lack of practice. Secondly, the current management system of wetland protection is not very clear.namely,the implementation of department management system caused blurred the boundaries of responsibilities and powers, comprehensive coordination management system caused the problem that coordination mechanism and the weakness of coordination.Thirdly,the specific legal system of wetland protection is not perfect,the licensing system of wetland development and wetland paid has not been established and the environment impact assessment for the wetland system,the system of wetland ecological compensive system of Wetland Park,the system of wetland public participation also need to continue to improve.Reference to the United States,Japan and Australia’ wetland protection legislation experience and coordinate the situation of china’s wetland put forward suggestions to improve the legislation of wetland in China:to develop "the people’s Republic of China Wetland Protection Regulations" to solve the shortage of national level specialized legislation of wetland,according to the local conditions develop the provisions of operation regulations. Secondly is to clear the protection and management system of wetland,establish the system to adapt ecosystem,every department participation and comprehensive coordination mechanism of wetland protection.The last is to put forward suggestion to establish and improve the legal system of wetland protection.
