| The protection of wetland ecosystem is of great significance for our country's ecological security.However,the overall situation of our country's wetland protection is not going well.At root,the limitation of relevant legislation seriously affected the efficiency of wetland protection and management.Currently,there is no national legislation about wetland protection,in addition,local legislations are too limited and decentralized to guide or supervise the action of wetland protection and management,all of these have little intensify execution to prevent the tendency of wetland ecosystems degradation.Therefore,we try to do deep analysis on the limitation of existing legislations,coupling the idea of Integrated Ecosystem Management to legislation,in order to quest the approach how to materialize it in the legislation for conserving wetlands in China.This paper mainly adopt the manner of empirical analysis,comparative analysis and system analysis,and try to conclude the characteristics and values of Integrated Ecosystem Management.Combining our country's current situation,we try to analyze the problems of wetland protection legislation.Through the introductions and analysis the advantages of wetland protection legal system of England,America and Korea,we try to make suggestions for improvements in our country's wetland protection legislations.Except the introduction and conclusion,this paper is mainly divided into four chapter.The first chapter is an introduction that introduces the content and the theoretical basis of Wetland Integrated Ecosystem Management.Through defining the basic definition,characteristics of Integrated Ecosystem Management,we try to deeply understand its theoretical basis,and emphasize the importance of Integrated Ecosystem Management,especially the integrated preservation principle and the multiplicity of subjects principle.Apart from that,we analyze the difference between the integrated ecosystem management and traditional management,and believe that it is imperative to introduce the integrated ecosystem management legal system.In the second chapter,we mainly analyze the problems of current relatively legal system.After review our country's wetland protection legislations in the course of memories,and analyze the plight of legal standardization in the wetland protection,we believe that the problems are centralized on three aspects.Firstly,it is difficult for the traditional administrative mechanism to deal with so many problems exiting in the wetland.Secondly,the market adjustment mechanism is very immature.Thirdly,social adjustment mechanism is also very weak.The third chapter mainly introduce the superiority of wetland protection law in foreign national and the enlightenment to our country.Inductive and analyze the advanced wetland conservation practices in United States,Britain and South Korea,combine the situation of existing in our country,we should draw the following experience.Firstly,we should adhere to the principle of preferential protection,which means that we should make sure the wetland protection prior to the utilization.Secondly,we should take full advantages of the means of market regulation,by which to motivate the participation of diversified parties.Last but not the least,we need to pay attention to the development of public participation system,so that we can take full advantages of the means of society regulation,and ensure the sustainable development of wetland protection.The fourth chapter mainly introduce the legislative suggestion for the improvement of wetland Integrated Ecosystem Management.This paper offers some proposal to improvement the wetland Integrated Ecosystem Management legal system.Through the legalization of the Ecosystem Management,combine it with wetland conservation law system.Under the principles of Integrated Ecosystem Management,we provide several proposals to improve the legal system of wetland from the aspect of government function,market adjustment mechanism and social adjustment mechanism. |
