On Migrant Children's Education Right

Education right is citizen's right to receive education equally, which is protected by international Human Right Act as a basic right. UN Chart, Universal Declaration of Human Right and Economic, Social and Cultural Rights all have the content to admit and protect citizen's education right. The problem of migrant children is a new problem which arises as the plan economy turn into market economy. As part of children in our country, migrant children should have the same education right as the common children. But because of the limitation of economy, the money we invest into education is very small and is not equal at different places. And the migrant children are so poor that they don't know how protect their rights. Education legislation is not perfect enough and administration doesn't complete its duty is also the reason why migrant children's education rights are invaded. Migrant children's education rights are very easy to be harmed. It is difficult for migrant children to be at school and they are in poor conditions of education. They are sometimes discriminated and have difficulty in going to higher school. So our state should try different ways to safeguard migrant children's education rights.To protect migrant children's education rights is not only what constitution demands but also what International Human Right Act requests. Legislative Body should enact laws according to constitution and common laws to definite the obligation of the state, the family, the school and the society. Administration should provide migrant children fund for education and supervise migrant children's education rights. Administration of justice should provide ways to safeguard migrant children's education.The whole text concludes five parts about thirty thousand words .The following is to introduce the main content of the text.The first part is too definite the concept of migrant children's education. The situation of migrant children's education right has much improved, but there are still many problems. Migrant children are still not equal in education right with the local children. The education law system is not perfect yet and administration does not carry out the law at the same standard. The methods to safeguard migrant children's education right sometimes are not useful.The fifth part is to discuss how to safeguard migrant children's education right .This part is the center and is very important .At the beginning the text explains it is necessary to protect migrant children's education right. Then the text is to discuss the ways from two aspects, that is safeguard in advance and safeguard afterward.
