Our country’s economy has been rapidly developed since the reform and opening up. The transformation from “planned economic system” to “market economic system” promoted the large scale flow of domestic population. With a large amount of rural migrant workers pouring into cities, the migrant style changed from “moving alone” to “moving whole families”. Thus, more and more children in rural areas moved to cities where their parents worked. We called them “Rural migrant children or juveniles”because they always migrating to keep pace with parents’ job change and didn’t have the access to local registered residence or fixed accommodation. Under the shadow of existed laws, regulations, policies and systems in our nation, the issue of the compulsory education of these migrant children and juveniles has been a headache for quite a long time. Starting from 1996 to today, our government, together with relevant departments, has been committed to tackle down this issue. However, this group’s legal right of receiving equal education has been situating in lacking of forceful safeguard due to the complication of this issue. Education is the foundation of building a powerful country, thus the access to compulsory education for children of school age is extremely important. Migrant children and juveniles are an essential group in our country which cannot be ignored. It’s the obligation of a country under the rule of law to settle down the issue of compulsory education and to protect the equal right of receiving education. This thesis reflected the current situation of migrant children and teenagers’ right of receiving education from the aspect of institutional guarantee, with the research method of studying and comparing documents as well as going through relevant laws, regulations and documents. What’s more, it started from the basic concept, quantitative distribution and structure of migrant children with the help of available data and solid evidences. Through analyzing, we found the major factor of this issue concerning about the educational legislation and finance, household registration system, relevant mechanism of imputation and so on.For this, the author has put forward some advice for improving in the terms of pinpointing the equal protection of children’s right to receive education, detailing relevant safeguard measures, reforming the household registration system, perfecting the education financial system as well as establishing and perfecting imputation mechanism.The author also hopes that this paper can play a role in promoting to solve the issue of protecting migrant children’s legal right to receive education after discussing and putting forward relevant opinions...
