The Economic Law Regulation On The Falsely High Price Of The Medicine

As a special merchandise for cure the sickness to save the patient, medicine relates not only the safety of people's life and the guarantee of people's healthiness but also the right of existence, the right to be healthy and the right of development for people. The falsely high price of medicine have seriously affected the competition of the market, infringed the rights of the consumers and influenced the development of the health, which is not availed to the harmonious society. The falsely high price of medicine has become one of the most serious societal problems in China. The price of medicine is a complicated system project, which is contacted with system of stipulating for the price, medicine circulating system, hospitalization insurance system, health system and economic system. And it brings on the falsely high price of medicine because of the limitation of the factors hereinbefore.Basing on the analysis of the harm and reasons of the falsely high price of the medicine, I propose regulating the falsely high price of the medicine by economic law. At present, we analyses of the falsely high price of the medicine mostly in sociology or economics field. In this paper, I provide a new perspective to solve this problem.In the part of the regulation of macro-control law, firstly, I introduce the ways to regulate the medicine price in American, France and Japan and the apocalypse to us. Secondly, I provide some suggestions on the system of stipulating for the price, the system of medicine inviting public bidding, the system of health and the system of hospitalization insurance. Then, I suggest that we need to enact "supervision law of medicine price", cut down some steps of medicine circulation and implement method of public bidding, hospital compensation system, different management between many medical treatment organizations. Also I pay attention to how to create a reasonable distribution of income among people who are at work on medical field and change the method of payment for hospitalization insurance and so on. "supervision law of medicine price" is a importantsection.In the part of market regulation law, I try to analyses from two parts-the medicine market configuration and medicine market behavior. In the first part, I make suggestions on configuration of market of medicine making and selling. I have a detail description about system of medicine circulating, so I would not to explain this again. In the other part, I describe how to regulate price behavior and non-price behavior.
