At the end of the1990s, our country carried out the policy named MonetaryDistribution of Housing, which completely declined and replaced the policy---WelfareDistribution of Housing, we had used in Planning Economy Era, with nurturance anddevelopment of the past decades, Real estate had had relatively sufficient time todevelop itself, which also stimulate the development of the steel industry, cementindustry and electronics industry. Therefore, real estate gradually has a greatsignificance on the national economic construction. However, due to the undue risenhousing price, it also brings some side effects to the sociometric development of ourcountry at the same time, since the regulations done by our government play a veryimportant role.Real business is an emerging industry which contains a lot of potentials todevelop, but the greatly increasing price of the housing brings many bad efforts onpeople’s clothing, food, housing and transportation. Of course, the reasons why therises are a lot, including the costs of construction and installments of real estate, theprice of the land, the relationship between supply and demand and some speculativebehaviors in the industry of real estate. Our country also made many policies andmeasures to do the regulations, which includes the providence of land-offering, theprovidence of housing accumulation fund and economically affordable housingprovidence and so on, and they had made an evidential influence on the housing priceat some extends, with the lack of stability, steadiness and persistence, the policies justaddressed the symptoms and solved them temporarily, not digging for the essence ofthe problem. So no warranties from the legal system have ever been made, theregulation of real estate should be concerned and thought from the angle of law, andshould be studied as an issue of law.Nowadays, the legal systems made by our government which can do macrocontrol to the housing price includes land legal system, financial legal system, taxlegal system and the market management law system, and many fields of law will beinvolved with it. Meanwhile, there are many underripe things to complete, such as theissues mentioned behind: the generation of “Land Finance”, the omission of thesettlement tax of real business and the scarcity of Affordable housing, which need us tooptimize and complete at the coming reform. This thesis tries to explore and analyze the law system about real estate, and provides constructive suggestions to regulate thehousing price.
