The marital legislation that built in New Democratic Revolution time by Communist Party of China, was enacted and implemented, not only abolished the feudal system of marriage and family thoroughly, improved the status of women, push forward the process of the emancipation of women, but also has provided the rich experience and built the solid foundation for the new China's marital legislation. So studying the historical status and its limitations of the new democratic marriage has important reference to the new time rights and interests of women's safeguard profits. This article research mainly obtains from the below aspect:In the first part, the author inspects the marriage legislative work that built in each historical period of the New Democratic Revolution time by Communist Party of China. From the marriage law basic principle, the marital establishment maintenance, marital relieving and inherits such as the lifting of the four, the author discusses in detail the various periods of development of the institution of marriage and inheritance.In the second part, the author uses massive historical data,the example and so on, from women's family, the economical, political, the culture and education four aspects, inquires into the new democracy's marital legal system's establishment and the implementation, which brings profound changes to women's social status.In the third part, the author carries out the new democracy's marital legal system with the feudalism marriage system, the new China's marital legal system and the Nanjing National government's marriage system by comparison, analyzes the new democracy marriage legal system's historical situation and the limitation.
