A Research On Safeguarding Migrant Workers' Rights In Labor Security

As a quite important part of China's industrial workers, the migrant workers have made great contributions to the economic and social development of China's cities. At present, the laws, regulations and policies in China protecting migrant workers have been becoming more and more perfect, but the conditions of migrant workers are still awful ,and their rights are still trampled such as the right of labor security. What are the deep-seated reasons for this contradiction? This is a question.This paper believes that the protection of migrant workers' labor security is the same as the game between laborers and capitalists.Meanwhile, employing methods of case study and literature analysis ,this paper discusses the protection of migrant workers' labor security from the perspective of the game theory. The unbalance of the fighting power between peasant workers and employers is caused by the factors such as the dual labor market, the lack of organization resources and its institutional disadvantage, the individual rationality of migrant workers and the tactics chosen by migrant workers and employers respectively. Under the background of the market directed policy and non-centralization of government power, local governments lose their inner motivation to execute the labor policies and protect migrant workers' labor securities, for the prompting of the politic evaluation system, the private combination of power and capital and the disabled inspection of the central government. As a result, the executing power of the government is becoming more and more inefficient.In a word, the situation of protecting the rights of migrant workers' labor securities reflects the composition of forces among the migrant workers, employers and the government, then we can make a conclusion that the essential cause for trampling the rights of migrant workers' labor security lies in the unbalance of their game powers . Based on the above-mentioned, the harmonious game route to be built among the migrant workers, employers and the government is to put forward in this thesis, which includes the following aspects mainly:Improving the comprehensive abilities of migrant workers, enhancing the organization of migrant workers,Intensifying the sense and criterion of corporations' social responsibility,Perfecting the system of political evaluation, strengthening the macro economic regulation,Reinforcing the public rescue system,Perfecting the method of three-party negotiation and solving the labor-disputes.
