Nowadays, we can not neglect the large amount and swift growth of the waste electrical and electrics equipment. It has potential harm to environment because it includes a large number of hazardous substances. But it is different from other solid waste, it can be turned into resource….Reusing and disposing waste electrical and electrics equipment in terms of the environmental standard, which not only is a powerful support to protect environment, but also is useful to resource-efficient. It is meaningful to build a resource-efficient and environment-friendly society in our country, and it is the demand of the sustainable development and recycling economy. So it is necessary to perfect the legal systems of the waste electrical and electrics equipment management.So far, there is no special international legislation of the waste electrical and electrics equipment, which is a defect of international environmental law. But countries of the world explore and perfect the legal systems of the waste electrical and electrics equipment management all along. This paper not only introduces the legislation situations and theoretical principle of waste electrical and electrics equipment in microscopy, but also does detailed comparative study on structure of it in microcosmic, for the purpose of the comprehensive analysis of the legal systems of the waste electrical and electrics equipment management.This paper is divided into five parts:The first part is the summarization of the waste electrical and electrics equipment. This part introduces the concept, the character of the waste electrical and electrics equipment. And it analyzes the urgency on constructing the legal systems of the waste electrical and electrics equipment management.The second part introduces the legal systems of the waste electrical and electrics equipment management in the world. Managing the waste electrical and electrics equipment through legislative means, various countries accumulate a lot of mature experience, and construct the perfect legal systems of the waste electrical and electrics equipment management. On European Union level, the waste electrical and electronic equipment (WEEE) and the restriction of the use of certain hazardous substances in electrical and electronic equipment (ROHS) was adopted, which directives promote the flourish of the other countries legislation. Japanese Home Appliance Recycling Law (HARL) set an effective system for waste electrical and electrics equipment. With a totally market-driven situation, the united states wants to construct the company-oriented manage mode, and the waste electrical and electrics equipment legislation in California is the most characteristic.The three parts is the theoretical principle of the legal systems of the waste electrical and electrics equipment management. In this part, the writer analyze minutely the Precautionary Principle, Extend Producer's Responsibility, Product Life—cycle Theory, Sustainable Development and Recycling Economy, in order to provide the comparative studies with the theoretical principle.The four part is the comparative studies on the legal systems of the waste electrical and electrics equipment management. The legislation of various countries is different because they need consider country's basic condition,international trends and the validity in constructing the legal systems of the waste electrical and electrics equipment management. This is the main part and improvement of this paper. In terms of object,responsibility,recycling,expense,governor, the writer compares and attempts to probe the overall character and personality.The five part is the design of the legal systems of the waste electrical and electrics equipment management in our country. The comparative studies aims to guide ours legislation of the waste electrical and electrics equipment. This part analyzes the current situation and deficiency in our legal systems of the waste electrical and electrics equipment management, draws the advanced experience from other countries, draw into License Granting Mechanisms,Margin System and Extend Producer's Responsibility, construct the suited legal systems.
