Research On Legislation Of The Waste Electrical And Electrics Equipment

Nowadays,we can not neglect the large amount and swift growth of waste electrical & electrics equipment(WEEE).WEEE has potential harm to environment,and can be turned into resource.WEEE is different from other solid waste.Reusing and disposing WEEE in terms of the environmental standard,which not only is a powerful support to protect environment,but also is useful to resource-efficient.And it is meaningful to build a resource-efficient and environment-friendly society in our country.Comparing with other countries,it is also a lower level and technique of reusing WEEE in our industry.Our legislation and management of WEEE has its own limitation.Studying on the law problems of WEEE,on the one hand,which can help to regulate the problems of WEEE by law;on the other hand, which is useful to reuse the WEEE and dispose it in terms of the environmental standard.We have made some law about the reusing and disposing of WEEE,which provides a foundation to our legislation of WEEE. Legislation of WEEE should base on the theory of sustainable development and circular economy;should start from our today's situation;should consult the mature experience of the developed countries;should extend the producer's responsibility;should assign the responsibility of the producer,the seller,the consumer and the institution of reusing WEEE.The core of the legislation of WEEE is to construct a systemic and realizable institutions,such as administrative supervision institution,economic stimulative institution,information opening institution and so on.The legal institutions of the WEEE is the legal safeguard to the management of the WEEE.This paper is divided into five parts.The first part is the summarization of WEEE.This part introduces the concept,the character of WEEE.And it analyzes the problems bringed by the WEEE.It clarifies that the reusing and the environmental disposing of WEEE can influence effect of protecting environment and resource-efficient in our country.The second part is current situation about WEEE.Basing on our national fact,this part introduces the origin of our WEEE, analyzes current situation of our national reusing and disposing of WEEE.The third part is the studying on the developed countries'legal institutions of WEEE.It is valuable to study the mature experience of the developed countries'management of WEEE.Most developed countries regulate the reusing and the management of the WEEE by legislation,and it is proved that it is a good way.It is necessary to implement the responsibility of reusing WEEE of the producer and enlarge the producer's responsibility.The paying of the fee should differ from the different fact.The fourth part is about the basic problems of our legislation of WEEE.Firstly,it introduces the concept of the legislation of WEEE.Secondly,it analyzes our status in quo of legislation of WEEE,and points out some problems.Finally,it gives some advices about perfecting our legal system of WEEE.This part's analysis starts with the necessity and feasibility of legislation of WEEE.The fifth part is how to construct our legal system of WEEE.It is the main innovation and the keystone of the paper,and also is the key of our legislation of WEEE.Firstly,this part analyzes the theory foundation of the legislation of WEEE.Secondly,this part points out the main principle of the legal institutions of WEEE.Finally,it explains the content and the enforcement of producer's responsibility,which is the key content of legislation of WEEE.Then it gives some material design of the institutions,such as economic stimulative institutions, administrative supervision institutions,licence institutions and so on.
