Research On The American Diversion System Of Juvenile Delinquency

Traditional juvenile system pays more attention to the punishment for juvenile, but that does not get good result. According to the practical result, the idea to educate the juvenile delinquency by punishment is not recognized .the American diversion system solves those problem. Because they pay more attention to education .we china should learn from them and construct our own appropriate juvenile diversion system. First by one case we analyze the concept type and element of diversion. And then we introduce the criticism of diversion. At last we get the conclusion that we should construct our own appropriate diversion system.There are three parts in this thesis. The first include chapter one and chapter two. They introduce the concept and theory of diversion. According to the introduction of concept and the analysis of the theory, we can understand the character of diversion. The second part includes chapter three and chapter four. They introduce the type and significance of diversion. Diversion stresses the compensation and resume of the crime sequels. For the victims it is effectively practical that the criminals will carry out duties of compensate properties or providing services to them. On the other side, the compensation will enhance the regulation consciousness of other potential criminals, and make them realize that once breaking the criminal law, they will not only take the rap but also have to compensate for the damages of the victims, in addition they will be brought to account by victims. In this sense, diversion can not only reduce the reconcussion to social relationships induced by penalty to the greatest extent and soothe the intense relationship between the criminals and the victims, but help to build trust and understanding between people and reduce conflicts in order to prevent crimes, the last part includes chapter five and chapter six. They tell us the practice of diversion in some other counties. And we should use foreign diversion system for reference selectively and generally built the presumptive judicatory system and diversion system suitable to our country.
