Constitutional Analysis To Publicizing General Village Affairs

Since publicizing general village affairs produced spontaneously, developing and perfecting through these many years, it has already evolved an important system of the democratic management in the rural areas of our country and the healthy development of self-administration of villagers positive safeguard. Publicizing general village affairs is very important in the self-administration of villagers. And publicizing general village affairs has the significant significance regarding villagers' participation in politics and deliberation over governmental affairs, village cadre's being incorrupt and self-discipline, improvement of the relationship of cadre and masses as well as the rural economy development. At present, it has already obtained the universal promotion and the innovation in our country countryside and achieved the huge achievement. But as an important innovation of institution in countryside democracy construction, it is slightly immature in compares to the villagers' electoral system in self-administration of villagers. It is still located at the boundary zone of villager self-administration. Therefore, the author thought that publicizing general village affairs will become the key to self-administration of villagers developing from now on.The thesis is divided into four parts and the abstract is as the followings:The foreword introduces the researching motive, the researching area and the meaning of this research.Chapter One, outlines of publicizing general village affairs. This part is basic knowledge of publicizing general village affairs. The author first elaborated to self-administration of villagers, mainly analyzed the relations between self-administration of villagers and publicizing general village affairs, summarized positive the significance in publicizing general village affairs to self-administration of villagers; then dissertated its the concept, essential feature and other factor; after elaborated its theoretical law basis( people's sovereignty theory and right to know theory); finally analyzed significant significance regarding villagers' participation in politics and deliberation over governmental affairs, village cadre's being incorrupt and self-discipline, improvement of the relationship of cadre and masses as well as the rural economy development.Chapter Two, development process of publicizing general village affairs. Since 1982 constitutions implements self-administration of villagers in the countryside, publicizing general village affairs gradually produces spontaneously in some place of our country countryside. The author, according to time sequence of development process, divided into four stages approximately (the stage of production spontaneously, the stage of primary construction, the stage of expanding rapidly as well as the stage of deepening development). This chapter, according to this time order, was unified the massive materials to review development process in our country and summarized to feature and rule.Chapter There, frame and forecast of publicizing general village affairs' system .This chapter is the key to full text. The author, through from the content, the procedure, the form and surveillance mechanism, analyzed carefully its present system from the Country and place and put forward several proposals to its development and the consummation in the future. This chapter has first analyzed its content through to state law's stipulation and local innovation; then divided in its procedure according to the different basis, and analysis essential part of procedure (the time of publicizing general village affairs); after divided in its form which present the local practices and dissertated; then analyzed its surveillance mechanism from the self-surveillance, the administrative surveillance and the law relief; finally, last part in this chapter put forward several proposals from legislative, the surveillance, judicial as well as the public education for work's key (system's consummation in the future).The conclusion part carried on the summary to the article.This article elaborated elementary theory, reviewed development process and summarized different characteristic and the rule, analyzed objectively existing system from the different angle and proposed several suggestions regarding the future work's key point in the above foundation. I hoped that this article can have a benefit for its consummation and the development in the further.
