On The Perfection Supervision System Of Village Affairs In Our Country

Anti-corruption has always been one of the important contents of the Chinese Communist Party governance of the country.Since the 18 th National Congress of the Chinese Communist Party,The state has stepped up its efforts to combat corruption,from building the list of powers to the deepening the reform of the supervisory system,each of which focuses on keeping power firmly tied to the cage of the system,and strive to achieve the restriction and supervision of power.But,with the continuous deepening of the reform,various social contradictions have been limited one after another,and one of its manifestations is the conflict of the relationship between the cadres and the masses and the mass events caused by the corruption of small and micro-power in the rural areas.The reason is that the village supervision system is not perfect enough to realize the restriction and supervision of the village-level public power.Therefore,it is necessary to establish and perfect the village supervision system.First,it can restrict and supervise the standardized operation of village-level public power,curb village official corruption,guarantee the legitimate rights and interests of villagers,ease the relationship between cadres and masses.Secondly,it can promote the construction of modern village governance capacity and governance system and thus guarantee the strategy of village revitalization.Third,it can stimulate villagers' enthusiasm to participate in rural political life and lay a solid foundation for grass-roots democratic politics.However,in theory and practice,there is much debate about the construction and perfection of village affairs supervision system.Through the analysis of the relevant provisions of the Organic Law of the villagers' Committee,It can be found that the design of the current supervision system of village affairs is a system of internal and external combination.In the inner part of the autonomous body,it mainly relies on the two main supervisory bodies of the village affairs supervision committee and the villagers themselves to supervise,while the exterior of the autonomous body mainly relies on the township government to supervise,and it can also be seen that the external supervision force is relatively single and weak.At the same time,due to the influence of the imperfect legal norms of village affairs supervision between township government and village-level organizations,as well as the influence of traditional village society,the running effect of the current village affairs supervision system is not ideal.Therefore,most scholars advocate the establishment and perfection of the three-dimensional village affairs supervision system combining internal and external participation from the relevant provisions of the current law.Of course,some scholars disagree with this point of view.They argue that the contents of the village affairs supervision system should be embedded in the existing one-shoulder mode,either by abolishing the village affairs supervision committee or by removing the village affairs supervision committee incorporated into the standing body of the villagers' meeting.But the latter two can't solve the problem that the village affairs supervision committee is restricted in performing its functions and the villagers' own supervision power is limited,and the supervision of township government is not effective.Therefore,this article from both autonomy and effectiveness to proceed,from the angle of institutional practice,combined with the theory of constitutional power restriction principle,the basic principles of human rights and the rule of law,and the use of legal normative analysis of in-depth analysis of these issues and reason.At the same time,combining closely with the strategy of village revitalization and relevant laws and regulations,this paper puts forward the way of perfecting the organization of village affairs supervision committee,activate the function of villagers' meeting and perfect the village recall system to realize the internal supervision,which is mainly supervised by village affairs supervision committee and supplemented by villagers' own supervision.In addition,in addition to strengthening the supervision responsibility of the original township government,it also actively introduces multiple external supervision forces,such as social organization and supervision organs,to ensure the dual realization of autonomy and effectiveness of the village affairs supervision system.In view of the complexity of rural society,this paper mainly expounds the supervision system of village affairs from three parts.The first part mainly solves three problems: The first is to sum up the connotation of the village affairs supervision system by combing the formation and development process of the village affairs supervision committee and the relevant laws and regulations.Second,the theoretical basis of sound village affairs supervision is analyzed from the theory of constitutional law.Third,the necessary significance of perfecting the supervision of village affairs at present.The second part mainly introduces the current situation and cause of formation of the village affairs supervision system.It mainly includes the achievements made by the village affairs supervision system in organizing,constructing the legal norm and supervision mode,as well as the problems existing in the grass-roots township governments in the performance of the villagers' self-government supervision power by the village affairs supervision committee.Then from the legal system imperfect administrative power subsidence and rural social environment and other aspects of the reasons for the above-mentioned problems to make an analysis of the above-mentioned problems.The third part,through the discussion of the above two parts,it is proposed to establish and perfect the modern supervision system of village affairs,which combines internal and external participation with multiple participation.which is mainly composed of internal supervision of the autonomous body,supplemented by external supervision with multiple forces participating in it.Specifically,In the interior,we should perfect the organization of village affairs supervision committee,activate the function of villagers' meeting,perfect the recall system;On the outside,strengthen the supervision function of the grass-roots township government,introduce the social organization supervision force and give full play to the supervision responsibility of the supervisory organs.
