Empirical Study About The Present Situation Of Migrant Workers' Rights Protection In Panyu Distriction Of Guangzhou

Protect the rights of migrant workers is an important function of Chinese government in nowadays. This paper focuses on the unfair treatment to migrant farmers, in aspects of labor contract, wage pay, work time, work intension, welfare, and social insurance, and discusses about what government should do to protect migrant workers' right during labors transfer from country to town. How to maintain harmonious relationship among government, enterprises and migrant workers is a hot topic in academe and society.This paper surveyed 230 migrant workers and Company L by questionnaires in Panyu district, Guangzhou, and found the follows points, (1) the rights of migrant workers is lack of protection and fair treatment, and workers are in the dry tree when face local government and enterprises. (2)In order to reduce cost but not lower product quality, enterprises are inclining to compress the payment of workers and avoid take social responsibility. (3) Local government like to stand on the side of enterprises when they make policies and carry out administration, that because local government want to abstract more capital to purse the development of local economy. According to the above reasons, enterprises and local government are often in the same side in lawsuit of work. Both enterprises disobey labor laws and local government misses its responsibility due to the feebleness of migrant workers in labor and capital relationship.According to the serious problems found in above investigation, if government want to keep harmonious between labor and capital and realize the economic development, the local government should strengthen the establish of various labor laws and regulations, redefine the role-play among government, enterprises and workers in the protection of migrant workers' rights, build regulation and enhance supervision to balance the relationship between labor and capital. What's more, local government must establish a set of laws to protect migrant workers' legitimate rights and interests under the principle of market. By this way can realize the common win among government, enterprises and migrant workers. It also can enhance local competition power, making it sure that economy develop smoothly and maintain stable society.
