Research On Disability Adolescent And Children Cultural Rights Protection And Government Responsibility

The disabled can share social life fairly is an important hallmark of a civilized and progressive society. However, the rights of disabled people are always the shortest wood plate which consist the "rights cask". It exposed many defects of the human rights protection system. The society will settle into a peaceful and harmonious beauty only while the condition of the disabled gets more attention and their rights get more respect and safeguard.With the development of the economy, and society of China, the disabled people are hunger for spiritual life. Cultural rights and interests is the guarantee that people can pursuit of spiritual life and gain benefits in the procedure. It’s one of the basic rights of citizens. Everyone shares achievements of development of technology and culture; allocation of cultural resources obeys the principles of equity and social justice; everyone has equal opportunity to be educated and acquire cultural service. All above are the core means of cultural rights and interests.This thesis, which guided by the Marx’s theory of the all-round development of man, studies on the government responsibilities in cultural rights and interests protection of disabled adolescents and children. The paper defines connotations in cultural rights and interests of disabled adolescents and children as well as the government responsibility systematically. Based on existing related studies about culture rights and interests, and protecting the rights of people with disabilities. This paper chooses Hangzhou as the case, the spiritual life and needs as entry point, then descript and analyzes measures, results, defects and shortcomings of the protection of cultural rights and interests of disabled adolescents and children in Hangzhou. It’s be analyzed that the cultural consumption level of disabled children and teenagers is still low, their spiritual and cultural life poor and they’re lack of cultural identity. Security system of cultural rights and interests also has some defects such as imbalanced development in special education system, ineffective public culture service for vulnerable groups, lacking of legal support and so on. From qualitative analysis, I attribute the obstacles of the implementation of the cultural rights and interests of disabled adolescents and children to social exclusion, lack of government cultural functions and the limits of their own conditions.Finally the author proposes some suggestions in three aspects consist of "self-protection","legal safeguard", and "administrative guarantee" to help government performit duty. In order to protect cultural rights and interests of disabled adolescents and children, the government should use its predominance to hoisting capacity and consciousness of rights safeguarding of the subject, improve laws and regulations, improve policies and systems, improve the overall range, strength, level and quality of the protection of culture rights and interests of disability children and adolescent.
