In a harmonious and stable labor relations and the establishment of law truly protecting migrant workers'the right to work in the present moment is an important task.The first chapter of thesis briefly describes the labor of migrant workers the right to protect the status quo and problems. By introducing appearance of the peasant laborer , the developing condition ,characteristic , attribute and their right to work guarantee, chapter I explains the problem of peasant laborer right to work and the necessity and urgency of protecting peasant laborer's rights and interests.Chapter II is the academic analysis of the lack of the migrant workers'labor rights to protect and exploring the reasons for the rule of law. Based on the concept of labor rights, the nature, characteristics, function and value to the public of the right to interpret for the public and farmers social status of the main reasons for the deletion analysis, the author argues that labor rights and the public's right to be missing migrant workers rights and interests have not been effectively protected the important reasons; and proposed legislation to protect missing, lack of law enforcement and judicial safeguards to protect migrant workers are missing labor violation of the rights and interests of the rule of law level factors.Above two chapters basis, the third chapter pounds the legal system how to build up the guarantee of peasant laborer's right to work again and expounds government self-examination ought to compose out on this problem.
