It is veryimportant for promoting sustainable development of social and economic and building aharmonious society that ensuring energy security, energy economic, energy clean andsustainable supply of energy. Rapid economic development of china based on a largenumber of energy consumption, which has brought a lot of energy issues. For example,irrationality of the energy structure, the much lower use of energy, security of energysupply and energy use, the contradiction between the development of energy andenvironmental protection etc. In recent years, With the rising speed of development ofour national economy and the speeding up of china’s industrialization, China hasalready become the large energy production and consumption nation. One of the majorfactors limiting the development of our national economy is the Energy problem causedby the development. To solve the issues of energy bottleneck to economic development,countries in the world are seeking the way of energy, environment and economysustainable development.Since1973, Western countries had broken the third oil crisis and the energy crisis.On the issue of energy shortage awareness and the need to develop new energytechnologies, Many Western countries have accelerated the relevant work of nationalenergy legislation. Such as, pay close attention to developing energy law, energy-linelaw of the energy field, compilation of national energy law etc. Energy legislation beganin earnest. There is a new peak of the world’s new energy legislation in the twenty-firstcentury, In the current, through continuous improvement of energy legislation, manydeveloped countries have established a relatively complete legal system of energy, Itmeans that energy law developed more and more detailed, more complete. Throughdecades of efforts, China’s energy legislation has begun to take shape, the prototype ofenergy legal system has begun to build up.This paper interpret the content of the system of energy law from the perspective of jurisprudence, The system of energy law are talking about not only refers to the systemof energy legislation, but to all energy-related laws and regulations, which aresystematically included in the system of energy law according to their differentcombinations. This paper analyzes situation and existing problems of the system ofenergy law in China, By learning from advanced experience in the energy legislationand the building of energy legal system of the major developed countries, mainly theUnited States, Japan, Germany and Australia etc; comparison of the basis of energylegislation and construction mode of the system of energy law in the domestic andinternational; combined with our domestic energy legislative practice; through theestablishment pyramid structure of the energy system of legal structure, constantlyimprove the energy system of legal norms and the establishment of a sound legal systemof energy, making recommendations for the improvement of the system of energy law,with a view to build the system of energy law with Chinese characteristics andsystematic study on China’s energy legislation.
