A Research On The Whole Benefits Value Of Regional Economic Legislation In China

Regional economic legislation refers to all the activities conducted by local governments to make or amend economy-related legal regulations which take effect only within its own administrative region. The ultimate aim that regional economic law pursues through the standardization and amendments is also the value of regional economic legislation.It is of great importance to the regional economic legislation itself to make a study on its peculiar value orientation which is also its essential issue. By the research on the general values of economic law and analysis on the special attribute of regional economic legislation, this paper is to make a conclusion that the range of its effectiveness and localization of its rectification will not influence its pursuit on the whole social benefits, on the contrary, the direct pursuit of whole social benefit is actually the uniqueness of its value.Due to the special historic background, its value in pursuit of the whole social benefits should embody the augmenting effects in the national economic legal system innovation. Legal transplant is a significant method to propel national economic legal system innovation, however, as a result of various reasons, there is high risk in implementing it in economic field in China. Therefore, the author puts forward " staged transplant", which can be adopted to diminish the risk and cost and meanwhile enhance the ratio of success of legal tranplant, while the whole social benefits can be also better achieved during this process.The regional protectionism is another big issue, in some places, local economic legislation has even legalized regional protectionism and been contributive to its development. The author's opinion in regard to this issue is that China's socialist political system and single state system has determined the relationship between the local and the central government is distinctive and different from that in capitalist federal goverments, which makes it necessary for regional economic legislation to embody all-around awareness and set the whole social benefits as its own value orientation.
