Worker dispatch service,as a special form of work-use,involve in three principal parts including worker dispatch service provider, accepting entity and dispatched worker. Because of the separation of employment and use, and the shortage of relevant legislation, the dispatched workers often can't receive the same pay for the same work, which badly harm the interests of the dispatched workers. As The Labor Contract Law come into force, the right of receiving the same pay for the same work of dispatched workers get its legal protection. But there are still many problems due to the abstract of prescripts:how to determine the confine of "receive the same pay for the same work"? and who respond to dispatched workers? and what responsibility should be charged with when law is broken? and so on. In order to protect the dispatched workers, I put forward some proposals about the problems above.The paper is divided into three main sections.The first part is the general comprehension of receiving the same pay for the same work. In this section, the comprehension of receiving the same pay for the same work in different points of view is put in the first place, including plutonomy and law. Then on the base of Worker dispatch service's character, I point out the main body of obligation and consult object of receiving the same pay for the same work. Finally, the bound of "same work" and "same pay" is confirmed.The second part is the actuality of receiving the different pay for the same work in our country. The actuality is first displayed,and then I analyzed the harm of this phenomenon. Finally, I give a deep consideration to the cause of receiving the different pay for the same work in our country.The third part is the perfection of our Worker dispatch service system. In this section, the feasibility of receiving the same pay for the same work in our country is first bring up. And then some pertinent advices are put forward to perfect our Worker dispatch service system at the foundation of the foregoing analysis.The achievement of receiving the same pay for the same work is a complicated work, which involve in many factors such as law, polity, economy, society, and so on. Limit to my knowledge level, I only make research on the problem of receiving the same pay for the same work in Worker dispatch service, which is a little special. The methods of my research mainly limit to the area of law, and a few economic methods added. I only hope this paper can enlighten and encourage my persistent consideration on this problem.
