A Research On The Influence Of The New "Labor Contract Law Of PRC" On The Migrant Workers

With the development of our country urbanization level, the phenomenon of the massive migrant workers entering a city become the current of social development, the status of labor relations has directly influenced the other social relations after the migrant workers entering the city, and it determine on the origin and evolution of the migrant workers' problem. The migrant workers' question has caused wide public concern of the scholars in various fields. It reflected the contradiction between supply and demand in the labor market and revealed that the disharmony between labor relations and economy development of our country. Therefore, establish migrant workers' labor relations and keep them harmonious and stable has became the requirements for developing harmonious and steady society, and it's the responsibility of the country and community. So, after the reformation of the new "Labor Contract Law of PRC", the country has formulated a series of laws and regulations in order to reflect the influences and effects of the migrant workers' labor relations during specific implementation. The purpose of the research is correlative problems, achieves the estimate of the migrant workers' labor relations for the reforming of the new "Labor Contract Law of PRC".The visual angle of this research from systems analysis, use the method of research that combine with sociological analysis and character analysis, through 400 migrant workers' questionnaire survey, it analyses the labor relations' actualities and problems of the migrant workers roundly, by the numbers and deeply recently, and it also analyses the relationship between migrant workers and time system, labor safety system, labor salary system and insurance system. In virtue of the new "Labor Contract Law of PRC" to reform the pivotal variable, bring forward a basal hypothesis that the reformation of the new "Labor Contract Law of PRC" could influence the adjustment of the migrant workers' labor relation, and point out four basal hypothesis: Firstly, the new "Labor Contract Law of PRC" has influence on migrant workers' labor time adjustment; secondly, the new "Labor Contract Law of PRC" has influence on migrant workers' labor safety adjustment; thirdly, the new "Labor Contract Law of PRC" has influence on migrant workers' labor salary adjustment; fourthly, the new "Labor Contract Law of PRC" has influence on migrant workers' social security adjustment.The results from the reformation indicate that the reformation of New "Labor Contract Law of PRC" do not have any noticeable effect on the labor time of migrant workers; the reformation of New "Labor Contract Law of PRC" do not have any noticeable effect on the labor safety of migrant workers; the reformation of New "Labor Contract Law of PRC" has noticeable effect on the labor salary of migrant workers; the reformation of New "Labor Contract Law of PRC" do not have any noticeable effect on the social security of migrant workers. Based on acute analysis of those results, this study has further discussion on some aspects of New "Labor Contract Law of PRC" should be perfected, this will stimulate the establishment of harmonious and stable labor relations, then benefit the long-term social stability and harmonious improvement of our country.
