Soft constraints of decision-making means that it is a universal phenomenon which runs through all aspects of, steps and processes of decision-making. It is the lack of rigid regulation of decision-making system, but it makes effect. Based on this definition ,this article analyses its basic form, that is the soft constraints of the main decision-making, the soft constraints of process ,the soft constraints of the effectiveness, the soft constraints of administrative supervision and the soft constraint of responsibility .It because that the Governments and enterprises have not completely separated, and the Government participates market competition, and the lockage of process. Meanwhile, such three kinds of factors including the use of ethical standards of assessment, the lack of monitoring of the decision-making, and the political pursuit of decision-making without taking into account the legal responsibility lead to the soft constraints. Not only in China decision-making shows soft constraints ,but in other countries decision-making process shows "soft " situation. In connection with national administrative reform, the Western countries take measures to control the soft constraints, including the separation of d decision-making, implementation and monitoring, and the separation of government and enterprises, and monitoring of procedure and public participation. For the concrete practice of China, the article put forward to overcome the soft constraints decision-making in China. Adhere to the fundamental one is to establish more scientific, more democratic and more legal system, improve and perfect the system of expert advice, and expand citizen participation, and establish accountability in decision-making.
