Research For Legislative System Of Beach Closings Based On The Environmental And Ecological Protection Of The Ocean

The ocean is an important part of the global life-supporting system, and it is also the valuable wealth that can help to achieve sustainable development of human beings. From the coastal fishing industry, salt manufacturing industry to the development of deep seabed resources exploitation in the twentieth century, human have got great progress on exploiting and using resources in ocean, and have improved the quality of life to a considerable degree. From the"Reform and Opening"on, the coastal areas of China have become the most booming region on economic development, depending on the geographic advantage and recourses strength of ocean. With the quick development of economy and society, the population of the coastal areas has become more and more, and the environmental pollution and ecological destruction is getting worse and worse. In February, 2008, for the serious environmental pollution and ecological damage of the ocean, China released the overall plan about the sea areas named"National Plan for Development of the Ocean". The plan put the sustainable use of ocean resources, the protection of ocean environment and the protection of ocean ecology forward, and proposed to build the system of beach closings. The program of studying and formulating the system of beach closings has made a timely manner, which will promote national economy on ocean, the social and economic sustainable development and the development of exploiting and using ocean recourses. For the problem of beach closing system, neither in theory nor practice, China has not formed a unified and comprehensive system. The legislative system on beach closings has not been built in our country, and there is still lack of deep study on the legislative system on beach closings. Based on the latest information on national and foreign experiences of developing, using and supervising the ocean resources and the laws about protecting the environment and ecology of the ocean, the article analyses and summarizes the legislative system and ocean management of foreign countries and of our country in depth. Based on the deep study of the theory and the ways on ocean management, combined with the situation of the ocean of China and the marine function zoning, the article analyses the types of beach closing system, proposes the standards of beach closing, opening, and managing the ocean environment. And puts forward the establishment of the institutional framework of beach closings ultimately.
