Study On Vaolation Of Land Laws Of Rural Areas

Land is a kind of resources can't be renewed. And it is one of the most important production goods in social development. Protection of land resources related to not only China's economic development and social stability, but also ecological protection and environment improvement in China. "Reasonable use of land, effectively protecting cultivated land" is a basic policy in our country. However, in recent years, with the promotion of economic development strategy, lands became main sources of income for some local governments, so large number of lands, especially arable lands are occupied. Large amount of lands have been illegally used to attract foreign investments. So the rule in order to guide the demand for land supply can't play its role. For example, to occupy lands without right or beyond right, to sell lands (agricultural lands and house lands) by illegal way, to build up houses illegally, to occupy collective funds by some individuals of base organizations. In addition, after the urban planning, authorization of homesteads have been stopped in many cities, and some homesteads were not approved to apply for houses. This brought the farmers to practical difficulties of living. The fact that failure to abide by the law in handling affairs, laxity in law enforcement, illegally occupying lands, illegally bargain of lands, and so on have lead to increasing of farm land cases, and such cases also easily lead to a new phenomenon of irregularities. Thus, to strengthen the punishment of illegal behaviors of lands and to reduce the occurrence of the phenomenon of illegal use of lands have important practical significances to protect lands resources, to promote social economic sustainable development and to strengthen the building of a harmonious socialist society.In this paper, the problem of lands and illegal behaviors to rural lands has been provided. It reveals that the causes of so many cases of illegal lands use in rural areas are complex and profound. Therefore, in order to build up a new socialist countryside, we must remove illegal acts of lands occupation and return a really clean area to farmers.This paper brings together a concrete manifestation of illegal behaviors to rural lands and makes a profound analysis of the causes and characteristics of the illegal behaviors. It provided a practical, effective and comprehensive solution to wipe out all obstacles to build a harmonious ecological civilization in rural areas.
