On The Government's Protection Of The Owner's Rights

In our practice of property management,the phenomena of disputes and invasion the owners' rights and interests emerge in endlessly,the owners' rights can not be adequately protected.When the owners are protecting their rights,the government needs to play an important part.But it can't provide sufficient and effective protection to the owners because of lacking correlative managerial experience and regulations.If things continue in this way,it not only destroys the government's image,but also threats the society's stabilization.So the government should change the function and the role, and handle the relations between itself,the owner and the property company.There are lots of discussion about protecting owner's rights and the concerns are different,but many of them are discussed from the perspective of civil law.In this paper, the writer talks about the government's responsibility to protect the owners' rights from the government's role.The thesis consists of five parts:The first part solves the basic problem such as the definition of owner,the character of the owner's rights,and the main manners of protecting the owners' rights by the governments.The second part introduces the basic theories of protecting the owners' rights by the governments from the point of view of economics,such as Information Asymmetry,social goods.The third part analyzes the legislation rules of owner's rights protection in developed county and area for the property right system,as well as property insurance system,the practitioner's qualification authentication,in order to make benefits for the owner's rights protection system in our country.The forth part analyzes the present situation of protecting owners' rights in our country's law,introduces some infringement cases made by developers,property companies and government,enumerates our country's current legal regulations,and points out the problems in our society.The fifth part puts forwards some legal countermeasures to improve it,such as changing the government's function and role,enhancing supervision and control to the property companies,coordinating the relations between the government and the Property Management Association and so on.
