With the deepening of economic globalization, foreign hotels gradually join in domestic tourism market, the competition increasingly focus on the service, and the level of service quality depends on the quality of staff, so the competition between tourism enterprises reflected more on the management of staff relations. Only treating staff as internal guests firstly, providing them a comfortable working and living environment, and dealing with labor relations well, staff would provide a high-quality service for external guests to enhance the overall competitiveness of the hotel. Tourist hotel staff has become the strategic strength to support the sustainable development of hotel, how to implement a perfect labor contract system and a reasonable employment model is a key job in the developing strategy of hotel, labor relations management has been an important component of strategic management from the day-to-day function management.Especially after the publication of"Law of the People's Republic of China on Employment Contracts"in the 2007, all kinds of industries are affected by varying degrees, generally their labor costs increase, while the rate of sighing labor contract has been a significant increase. Tourist hotels are facing great pressure to adjust during the implementation of the new law as one of the labor-intensive industries, including the lasting long working hours, labor insurance and other problems, however, this is just a good opportunity to improve the labor relationship management and advance the competitiveness of the industry for tourist hotels.The research uses literature research method, comparative analysis method, case analysis method and empirical analysis method. It starts from the basic theories of labor relations, and summed up the existing problems of labor relations in domestic tourist hotels, showing the non-standard employment, the low level of democratic participation, imperfect labor protection, unstable labor relations,and labor disputes increase rapidly and so on. The thesis analyzed the reasons: the lack of adequate legal foundation and supervision work, labor supply and demand contradiction, the social security system is inadequate,the individual sense of safeguarding the right is poor.In accordance with the idea of"discovery questions, analyze problems, to solve the problem", the thesis firstly organizes home and abroad labor laws, analyzes the new features of"Law of the People's Republic of China on Employment Contracts"-- to encourage long-term, democratic, normative labor, and analyzes the impact on tourist hotels theoretically, including the increasing cost of labor, pushing tourist hotels to adjust the model of employment, making staff of the hotel's have more room to choose. Subsequently the thesis takes Qingdao City as an example, investigates the status quo in labor relations in different stars tourist hotels in Qingdao:"Law of the People's Republic of China on Employment Contracts"has made some positive results, but there are still some difficulties in the implementation of the law and illegal issues.Finally, according to the new legal background, the thesis puts the labor relations theory into human resources management, and try to make some recommendations for the hotels to reaction"Law of the People's Republic of China on Employment Contracts", including stepping up publicity of the new law and broaden the Learn ways, setting up internal legal review system of labor management, adopting more flexible working hours pattern, actively adjusting employment model, as well as improving the lifelong employability of the staff to establish a new type of labor relations.
